Sheffield Crown Court heard on May 5 how Jason Derbyshire, aged 37, of Stanhope Gardens, Barnsley, had been in a van with his former partner when he was accused of flinging a hand which connected with his ex’s eye and he allegedly hit her two more times before pulling her out of the vehicle.
Frances Pencheon, prosecuting, said: “An argument began between them and the defendant flung a hand out and made contact with the complainant’s right eye causing pain and discomfort.

“He drove down a road and pulled her out of the van and the altercation continued.”
Ms Pencheon added the defendant left and the complainant was assisted by two passers-by and she contacted the police.
However, Ms Pencheon said the defendant’s former partner issued a retraction statement and did not wish to support the prosecution however the CPS continued with the matter on the basis of evidence from the 999 call and police body-worn camera footage.
